At outset of presentation I stated that I do not want a timeshare and I want to cancel my present timeshare. Salesperson said that Grand Solmar is a private residence club, not a timeshare, and she will help us cancel the old timeshare. She stated that we can have our expenses, ie. airfare, car rental, deducted when we visit this place because it is an investment property. She signed us up for Malibu rental who will market our property and who will give us a form to show to IRS that it is an investment property with tax ID #. She states this is completely legal. She will also sign us up with Valuetraded "VTW" to cancel our old timeshare. She had us sign a waiver that if we cancel, the money is nonrefundable. She and her manager continues to claim it is a private residence club which is like a fractional property but for 1-2 weeks, unlike a fractional which can be at least 1 month. The manager stated that it was not a timeshare, but a PRC, because we can use any week, any unit. We bought 1 week right to use in Grand Solmar vacation club, a timeshare with floating week. This is not tax deductible. We requested cancellation based on Article 32 and 56 of Mexican Consumer Protection Laws,ie. fraudulent statements given and illegally requesting us to sign away our right to cancel within 5 days with refundable payments. By making us believe that we can’t cancel our contract, my actual rescission period had expired. This is fraudulent and illegal business practice.Now they request in order to cancel I need to pay them 40% balance and payments already given are not refundable.
